TERMS & CONDTIONS: "XUV500 Incredible Experiences Contest"

• 01.  These below mentioned terms and conditions are for "XUV500 Incredible Experiences Contest" (Hereinafter referred as “Contest”)
• 02.  Who can participate:
  • a.  Participant should be aged 18 years and above.
  • b.  Participant should be an India resident.
  • c.  Employees of Mahindra & Mahindra Ltd (hereinafter referred to as M&M), Mahindra Group companies, affiliates and/or anyone connected with the contest and their families are not eligible to participate in the contest.
• 03.  Participate
  • a.  How to participate:
    • -  There is no entry fee for participation.
    • -  Any person can participate in the Contest only ONCE during the duration of the Contest.
    • -  Participants need to comply to all the contest requirements and enter their valid contact & details as per the form given on the website
    • -  Participants are solely responsible for time taken with regard to bandwidth connectivity and/or any other internet related issues during the Contest entry submission.
  • b.  How to enter your story:
    • -  Simply click on the 'Add Your Story' button.
    • -  Step 1: Enter your name and contact details. Purple Club ID (optional), Enter Start Destination and End destination.
    • -  Step 2: Mark your journey on the map
    • -  Step 3 : Add your Story title and the story and add the feature of XUV500 you used during the experience
    • -  Step 4: Upload Photos of your experience and add a video link if you have and click on Submit !
      
      
      Every story will first undergo a moderation process, and only then will it be published on the site. Please note that any content deemed abusive, defamatory, inflammatory, violent or commercial will not be published on the site. Please also note that images uploaded should be clean and decent. Any copyrighted image or image with nudity, children or celebrities would be disqualified.
  • c.  Featured Stories, which are displayed on the homepage, are stories chosen by us as examples of incredible, exciting content.
• 04.  Prizes of the contest:
  • a.  Prizes: Shortlisted stories will be published on our website and the participant will be informed by email in case his/her story is shortlisted.  One of the XUV500 select merchandise will be given as prize (for details please visit http://mahindraxuv500.com/product/merchandise.htm ). The prize will be one of the merchandise listed on website http://mahindraxuv500.com/product/merchandise.htm and it will be decided by M&M only as which merchandise to be given for a story as a prize and M&M’s decision will be final and binding on the winner.
  • b.  Any taxes & levies or any other expenses arising from the prizes will be the responsibility of the winners.
  • c.  Winners will be intimated by email provided by them on the website.
  • d.  M & M will require the complete postal address of the participants. The prizes will be sent to the postal address given by the winner.
• 05.  Winner selection:
  • a.  All winners will be selected as per M & M's discretion
  • b.  The jury if required shall be decided by M & M and the decision of M&M shall be final & binding.
• 06.  Duration of contest: Contest Period:
  The contest period is from 6pm on 22nd August 2012 to 6pm on 30th September 2012 (both days included) All entries, post 6 pm on 30th September 2012 will not be eligible for the contest.
• 07.  Winner Announcement:. The intimation will ONLY be sent to the winners and not to all the participants.
• 08.  Prize Disbursement: The Prize will be sent through courier to the winner's postal address as mentioned in the form filled by them.
  • a.  The Prize will be delivered through a reputable courier agency and M&M will bear the cost for a single delivery.
  • b.  If the Prize is undelivered/returns due to any reason whatsoever, M&M will not make any repeated attempts to resend the same.
  • c.  M&M will not be liable for any damage caused to the Prize during the transit. No request for replacement or change shall be entertained.
• 09.  M& M shall not be held liable if the communication pertaining to the winning entry doesn't reach intended participant for any of the following reasons as mentioned:
  • a.  Bandwidth problem of the mailbox/server of the host
  • b.  Incorrect e-mail address given at the time of submitting entry
  • c.  Inbox of the recipient being full/having insufficient space
  • d.  Any other reason, technical or otherwise, beyond the control of Mahindra and Mahindra Ltd.
• 10.  M&M reserves the right to suspend, shorten, modify, extend or cancel the contest at its sole discretion without stating any reason; no claim in this regard shall be entertained.
• 11.  M & M recommends that each participant should carefully read these conditions before they participate in the Contest.
• 12.  M & M reserves the right to modify these Terms & Conditions without any prior notice. An updated version of the same shall be available on the website.
• 13.  Participation in the ""XUV500 Incredible Experiences Contest"" (hereinafter referred as "Contest"), is purely voluntary and at the sole discretion of the person / individual. Participant agrees that he / she has understood and is bound by the terms and conditions set out herein.
• 14.  The entries submitted by any individual under this Contest or otherwise shall be treated as his / her own independent personal views and submissions; M& M, its group companies and/or its affiliates do not acknowledge or agree with any such content and further shall not be held liable for any defamatory, abusive language used and any loss occurring to any third party.
• 15.  Participant shall indemnify M& M, its group companies or its affiliate from any loss that may occur to M&M due to non adherence to these terms and conditions or due to submission of abusive, defamatory content submitted for the contest.
• 16.  M&M, their directors, employees, consultants, assume no liability whatsoever for any direct or indirect loss or damage arising from a participant's participation in the contest, or from M&M's termination or withdrawal of the contest, change of Terms & Conditions or for any loss or damage, howsoever arising.
• 17.  M&M does not exercise any control, nor does it have the means for exercising this control, amongst others, regarding the quality, originality, authenticity, legality, security or validity of the contest entries.
• 18.  Mahindra reserves the right to remove, refuse or cancel access to any participant without any reason therefore and shall be under no obligation to provide any benefits accrued under the contest.
• 19.  The participant shall not, without any valid license or authorization, use the intellectual property rights belonging to Mahindra and/or third parties.
• 20.  Contest is subject to force majeure events and situations beyond control of M&M, its group companies and/or its affiliates.

Other Terms & conditions

• 01.  Participant unconditionally agrees that he/ she shall not:
  • a.  do anything which violates any of the Terms;
  • b.  make any misrepresentation;
  • c.  do anything that does not comply with generally accepted internet etiquette including (without limitation) the excessive use of inflammatory or antagonistic criticism ("flaming"), or wastefully and unnecessarily including previous communications in any postings;
  • d.  perform system abuse;
  • e.  propagate, distribute or transmit Destructive Code, whether or not damage is actually caused thereby;
  • f.  Post abusive, obscene, threatening, harassing, defamatory, libelous, offensive or sexually explicit material.
  • g.  Intentionally make false or misleading statements.
  • h.  Offer to sell or buy any product or service.
  • i.  Post material that infringes copyright.
  • j.  Post information that he/ she knows to be confidential or sensitive or otherwise in breach of the law.
• 02.  There is no cash alternative and the prize / benefits are not transferable. M&M reserves the right to change any prize / benefits of the contest at any time without any prior notice or consultation.
• 03.  M&M reserves the right to offer the Prize to other entrants should a winner is unable, for any reason, to accept the Prize.
• 04.  Some of the Prizes may not be the property of M & M and all laws governing the same are applicable.
• 05.  The Prizes & the contest should not be used for any commercial gains by the winners.
• 06.  M&M takes no responsibility for the damages that the user may suffer due to errors or omissions affecting website content.
• 07.  Participant hereby authorises M&M to communicate with him / her from time to time about the matters connected with the Contest.
• 08.  Participants agree to make themselves available for publicity purposes if requested by M&M and agree to the use of their name, photograph/image and quotes for such publicity.
• 09.  In the event of a dispute the decision by M&M is final and binding and no correspondence will be entertained in this regard.
• 10.  All rights as to choosing the winner vest with M&M and shall be done as per the procedure adopted by M&M with or without supervision of any third party.
• 11.  Whenever called for, participant will be required to complete all formalities as may be communicated by M&M, its group companies and/or its affiliate including but not limited to providing his/her authentic and correct information, failing which he/she shall be disqualified at any time or at any stage. In case false information is revealed at any time after participation, the Participant shall be liable to return all benefits provided under the Contests.
• 12.  M&M reserves the right to restrict / bar any person from participating in the Contest without quoting any reasons for the same.
• 13.  Participants found indulging in any malpractices such as cheating or creating dubious profiles etc., shall be disqualified from the contest at any time and shall not be eligible for any prize.
• 14.  These Terms & Conditions and the Contest shall be governed by Indian law only. Any claim, dispute or lawsuit arising in connection with them or the Contest shall solely be subject to the exclusive jurisdiction of the Courts of Mumbai.
• 15.  All the content entered by participant becomes M&M's property and can be used by the company as, where & when they deem appropriate.
• 16.  It's assumed that the Participants who have successfully submitted their entry have read the Terms & Condition and agree to it without any conditions.
• 17.  This Offer is not applicable in a country outside India, any state of India if it is prohibited by law there.
• 18.  M&M shall not be responsible for any loss or damage due to Act of God, Governmental action, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for the same.
• 19.  M&M shall not be liable under any circumstances towards any loss or damage or expenses or cost or any third party liability, whether directly or indirectly, arising out or in relation to use or availing of any prizes and/or in connection with the said prizes as the case may be.
• 20.  The contest participants may be contacted on the mobile number and email shared by them during contest participation. M&M shall not be liable in any manner whatsoever for any participant who cannot be contacted on the mobile number or email as declared by the participant.
• 21.  The prize winners shall execute all such documentation as deemed necessary by M&M and allow M&M and their assignees to use, display, copy, modify, distribute, publish, sell, assign, exchange, license, sub-license, in all and all locations, in any medium, form or format, in any number, the picture, image or likeness and the reproductions of the winner, and any biographical information furnished by the winner to Mahindra.
• 22.  The winners shall be required to provide self attested proof of identity, confirmation of his/her mobile number along with the auto-response received acknowledging his/her participation, proof of residence and all other documentation as required by law.
• 23.  Winners must claim the prize in the manner communicated by M&M. The database of mobile numbers can be used by M&M in future for any lawful purpose as deemed fit by M&M.
• 24.  In case of change in date of contest or cancellation thereof for any reason beyond control of M&M, M&M shall not be responsible in any manner whatsoever.
• 25.  If any provision of these Terms & Conditions is held to be invalid or unenforceable to any extent for any reason including by reason of any law or regulation or government policy, the remainder of these Terms & Conditions other than those which are held invalid or unenforceable, shall not be affected thereby, and each provision of these Terms & Conditions shall be valid and enforceable to the fullest extent permitted by law. Any invalid or unenforceable Terms & Conditions shall be replaced with Terms & Conditions, which are valid and enforceable and most nearly reflect the original intent of the unenforceable Terms & Conditions.
